Terms and Conditions

Article 1 – Definitions

In these General Terms and Conditions, the following definitions apply:

  • Cooling-off period: The period within which the consumer may exercise their right of withdrawal.

  • Consumer: A natural person not acting in the exercise of a profession or business who enters into a distance agreement with the business.

  • Day: Calendar day.

  • Continuing performance contract: A distance agreement relating to a series of products and/or services where the delivery and/or purchase obligation is spread over time.

  • Durable medium: Any tool that enables the consumer or business to store information addressed personally to them in a way that allows future consultation and unaltered reproduction.

  • Right of withdrawal: The possibility for the consumer to waive the distance agreement within the cooling-off period.

  • Business: The natural or legal person offering products and/or services to consumers at a distance.

  • Distance agreement: An agreement concluded within a system organised by the business for the distance sale of products and/or services, using exclusively one or more techniques for distance communication.

  • Terms and Conditions: These General Terms and Conditions of the business.

Article 3 – Applicability

These terms apply to every offer from the business and to every distance agreement and order concluded between Elara Skin and the consumer. The text of these terms will be made available to the consumer before the agreement is concluded, typically via an electronic format that can be stored on a durable medium.

Article 4 – The Offer

If an offer has a limited validity or is subject to conditions, this is explicitly stated. The offer includes a complete and accurate description of the products.

  • Pricing: Prices exclude import duties and import VAT/GST. These additional charges are at the customer's expense and risk. The carrier will handle the import process and collect any taxes from the recipient.

  • Images: Images are a faithful representation, but manifest errors (such as slight colour variations due to screen settings) do not bind the business.

Article 5 – The Agreement

The agreement is concluded once the consumer accepts the offer and meets the set conditions. Elara Skin will immediately confirm receipt of acceptance electronically. The business may investigate the consumer's ability to meet payment obligations and may refuse an order or attach special conditions if there are justified grounds.

Article 6 – Right of Withdrawal

For product purchases, the consumer has 30 days to withdraw without giving a reason. This period starts the day after receipt.

  • The consumer must handle the product and packaging with care and only unpack or use the product to the extent necessary to decide if they wish to keep it.

  • To withdraw, the consumer must notify the business in writing or via email within 14 days of receipt, then return the product within a further 14 days.

  • The consumer is responsible for proving that the goods were returned on time (e.g., via a certificate of posting).

Article 7 – Costs of Withdrawal

If the consumer exercises their right of withdrawal, the costs of returning the goods are entirely at their expense. The consumer must account for the cost of returning items to the country of origin (our supplier in China). Elara Skin will refund the payment within 30 days of the withdrawal, provided the product has been received or proof of return has been provided.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal can be excluded for:

  • Products made to consumer specifications or personalised items.

  • Perishable goods.

  • Sealed audio/video recordings or software where the seal is broken.

  • Hygiene products (such as skincare or beauty tools) where the seal has been broken by the consumer.

Article 9 – Price

Prices will not increase during the validity period of an offer, except for changes in tax rates. All prices are subject to printing and typesetting errors. Elara Skin is not obliged to deliver products at an incorrect price due to manifest errors. Delivery takes place outside the EU; therefore, import VAT and customs duties are collected by the carrier from the buyer.

Article 10 – Conformity and Warranty

The business guarantees that products meet the agreement and reasonable requirements of quality. Defects or incorrectly delivered products must be reported in writing within 30 days of delivery. The warranty corresponds to the manufacturer's warranty and does not apply if the consumer has modified the product or used it incorrectly.

Article 11 – Delivery and Execution

Elara Skin will take the greatest possible care when executing orders. Delivery will be made to the address provided by the consumer. Orders will be dispatched as soon as possible, no later than 30 days, unless a longer period is agreed. If delivery is impossible, an alternative product may be offered, or the consumer may dissolve the agreement for a full refund.

Article 12 – Continuing Performance: Duration and Termination

Consumers can terminate open-ended contracts for regular deliveries at any time with a maximum of one month's notice. Fixed-term contracts cannot be automatically extended except for specific cases like magazines (max 3 months extension).

Article 13 – Payment

Unless otherwise agreed, amounts must be paid within 7 business days of the start of the cooling-off period. The consumer is obliged to report any inaccuracies in payment data immediately.

Article 14 – Complaints Procedure

Complaints about the execution of the agreement must be submitted fully and clearly within 7 days of the consumer discovering the defect. A response will be provided within 30 days. If the complaint is justified, the business will choose to either repair or replace the product free of charge.

Article 15 – Disputes

Agreements between Elara Skin and the consumer are exclusively governed by Dutch law, regardless of the consumer's place of residence.
